Need some quick advice re ebay purchase

Hi All,
I need some quick advice re an eBay purchase. Having not received a parcel I have just contacted the seller who informs me that the goods have been lost and that the courier (parcel2 go) will be refunding the value of the goods in full and intends to refund me the sale price.

"Hi, I'm really sorry, but I have just spoken to Parcel2Go and your package has been lost. I have put a claim in for it and have been told that I will receive a full refund for the value of the item. Which is good! I will therefore refund your money as soon as I receive my reimbursement from Parcel2Go, which shouldn't be very long I don't think. I will keep you posted and refund you asap. "

As I paid through pay pal I have a record of the transaction which has been completed.
Should I not be the beneficiary of the insurance allowing me to purchase a new item as title would have passed to me either when the auction was concluded or on conclusion of the paypal payment.
I got a good deal and would rather it didn't slip through my fingers.

I think speed is of the essence so advice would be greatfully recieved

He should be sending you out another one and claiming for the first one in the meantime. It's his responsibility to get it to you so you shouldn't have to wait.

Forgive the synicism, but it does sound a bit dodgy to me...

I deal with a few carrier companies and we have loads of stuff that goes missing. However, it's pretty rare that it's actually lost and I don't think they would own up to that very quickly. It's usually been 'misrouted' and turns up within a few days.

If it sounded like too good a deal, it may well be just that!

This is what PayPal have to say...

"Claims.

Reasons to File a Claim. A buyer may file a PayPal Buyer Protection Claim for one of the following reasons:

The seller did not deliver the promised goods. If the buyer does not receive the goods purchased, he or she is eligible for coverage. Buyers should wait a reasonable amount of time - at least a week - to receive the item, and then must first file a dispute using the PayPal Online Dispute Resolution process before the dispute can be escalated to a claim."

I would concentrate on getting my money back rather than getting the deal.

You should ask the seller to refund your money now. There isn't any need to wait as you're not going to receive the goods if they're lost.

If he doesn't agree, or he does and you don't get the money in the next few days, I would then file a claim with PayPal.

That's just my take on things. Hope it works out for you.

I ordered something a while back and it never turned up. The seller said he'd send another and it didn't turn up either. In the end he refunded me the full amount but he never told me to wait until he claimed from Royal Mail.

In the middle of one of these at the moment.

Seller had it in registered post. RM claim it was posted, but have no signature. Need ot wait 15 days before he can claim then will refund me. In the interim he posted another out to me on my request rather than refund. This arrived but was rammed through my door and no signature taken even though it clearly says so on the parcel. He is going to claim for that one too and refund me too!

Yup, if you lodge a complaint with Paypal they will refund money ASAP; buyer will be out of pocket until courier refunds him, but tough luck.

I had an episode recently where I paid with something by paypal and had thought it would arrive by email, but because of my own mistake I had ordered the mail-order CD instead (before you all think it's porn, it was a manual for a friend's car).

I bitched to paypal, they refunded without question. Then the seller emailed me to inform me of my mistake and sent me a free copy anyway - I of course went back online and paid for it like an honest citizen, but the point is that Paypal will refund on just your say so it seems.

I'm currently having a problem via ebay.
Won the item on the 19th. Nothing arrived so I emailed the seller yesterday who told me to contact them on Friday if it's not arrived and only then will they check if it's not been lost.

Why the F*ck would it take now one week to send a small parcel from England?!

It's not even much money. Just principle.
Ebay, great for selling, sh*t for buying

Prob the same reason that when I sold somethign last month and put Addressee: & Sender: I received the packaged the next day....

Ebay complaints procedure is pretty good, you need to wait a certain number of days before logging a complaint, so thats probly where the one week thing comes from....

I don't think a refund will be a problem but the goods have a new value of about £250 and I paid £50.
The query is who has title? and who gets what, I'm assuming the claim will be for the new value and as I have paid for both the goods and the carriage should this not be coming my way thus allowing me to buy new?

i recently had bother with fleabay, i bought something from ebay on the 30th of sept and nomally items turn up within a week but after a week and a half i contacted the seller and got no responce from him so i waited another week just to see if it had maybe got lost in the post or if i got a reply from the seller but i got neither so i sent the seller another message again and got no reply so i went and put a compaint into ebay which then showed me a link to paypal and to a page where you put in a complaint and ask for your money back throu paypal and the next day i had been refunded my money back.

i would try getting your money back that way stephen, it can only be worth a try :)

either that (above) or ask for immediate refund in full or you post neg feedback as well.

The claim is between him and the courier and has nothing to do with you, so there should be no delay in refund.

Also courier refunds can take months to arrive, trust me! (and thats if he isnt taking sh*t)

Maybe he decided he didn't want to sell at that price and the rest is bollocks. Ask him for a courier reference and call the couriers yourself - you can always check what value the package was insured for at the same time.
