Legal Advice Lotus kind of related

Post by r10crw » Mon Nov 02, 2015 5:08 pm

So been messed around for the last year with Z cars and now just found out they have gone into liquidation.

Absolutely gutted as they have a large amount of my money and the parts which they had purchased have gone onto other projects or not available now. I can get my car back with some of what they have done and can re instate the car back to what it was but essentially Im not any better off

Anyone help here or been down the same road??

As far as I understand it you have to get in touch with the administrators and lodge a claim. Unlikely you will get anything unfortunately but at least you will be on the list.
The order that debts are paid are:
1. Secured creditors. If the company borrowed money secured on property/assets.
2. Insolvency practitioners. After all, if they didn't get paid, they wouldn't do the job in the first place.
3. Employees. Redundancy pay and wages up to the value of £800.
4. Everyone else. Everyone else then gets a share, including customers, HMRC, extra money to employees, etc.

Make sure you get your property back asap. You don't want it being mistaken for a company asset. Sad news, I was thinking about this the other day wondering how it was getting on.

Thanks Mike.

Yeah sad news Fergus and I ill be down on Monday to collect the car. It really pisses me of as were speaking about nearly 10K and Im looking at getting back only 2 of work. 8 K is a hit Im not up for taking but have little choice.

As usual, everytime I rely on someone else Im let down. Charlene cant understand why I dont like people :)

Really annoying was getting pictures of the car with a drive box and engine only to find out they were dummy casings! None of which was iterated at the time.

That's rubbish, just take as much as you can while retrieving your property

Liquidation is one thing, but if parts were bought on your behalf and paid for by you then used elsewhere are they not still your parts? There may be some mileage there for you, but I could see it getting legal very quickly and if they are bankrupt getting compensation would not be easy even if you were legally correct.

Who gets paid first - Creditors or court judgements?

I would get there ASAP and take what is yours, even if you can just move it off the site until you have time to make arrangements.
