Take a look at how close both these drivers came to having accidents;

Looks like some of the reasons I gave up motorbikes, don't know if being in a metal box would help with these nutters

I had not long exited Harthill Srvices this morning when I had a bit of a close call. Accelerating in the inside lane to 70 the van ahead of me makes a sudden switch to the outside lane and there I am bearing down on some complete Duffer doing less than 10mph with his hazard warning lights on. Now clearly the fact he had these on made it an entirely sensible reason to stay on the carriageway and not pull onto the hard shoulder. The outside lane wasn't clear so all I could do was brake heavily to avoid rear ending him. Despite my obvious protests :evil: he continued crawling towards Jct 5 which made it really difficult for me and the cars closing down on me to overtake without causing a major incident.

If he won't take to the hard shoulder, you can ... pass him at 30mph on the hard shoulder, pull into (empty) lane 1 and then floor it ... works well in turbo diesel as he'll get covered in diesel smoke too :-)

I might take to the hard shoulder for emergency avoidance but I'm not sure I'd pass the stricken car on it?!

Undertaking is illegal, and if caught, you can get points for it, especially if you do it on the hard shoulder, and not just the inside lane.
Avoiding action is ok,

Surely you could argue the case that the speed differential was so great that whilst taking evasive action into the hard shoulder, you passed the slow vee-hickle?

Or that you had MMC'S discs and these do not work if they have not been used for a few miles. :D
