Anyone out there have any knowledge/experience of procedures with falling on ice in public places i.e. duty of care, negligence, responsibilty, liability etc of local authority/council.

Sorry, not much hope of a claim

I doubt you would get anywhere that. My Aunt fell on a pavent (no ice) but was due to workers negligence when doing up the town centre. She only tried to claim for her ripped tights and gloves even though in the process she broke her wrist and a finger or two, thats the older generation for you, no added on whiplash etc. In the end she got nowt.

One does get the impression that councils have it nipped up particularly tight now that every twat and his dog has tried to claim for stubbing their toe on a raised slab... Just harms the people that have a genuine claim for negligence (such as the above).

We are following the worst traits of America again. Remember the woman who either claimed or was awarded billions of dollars because she burnt herself when she drove away from MacDonalds with a cup of coffee between her thighs? She should have been charged with being an idiot.

Shopkeepers and companies here were not clearing the snow from the front of their premises as they could be sued if anybody slipped. What does that say for our Judges and Magistrates?

obviously feeling guilty for your /helpful comment earlier - how can you say this is a genuine claim without any knowledge of the facts?

Gritting/salting cases are notoriously difficult. Thankfully the Courts realise that in exceptional circumstances there can be times when peocedures, though whilst reasonable, can't cope. You can't implement a system year on year that would protect the public from worst winter since 1907 temperatures - its not reasonably practicable.

If you want to make a claim - write to the council. They'll tell you to FO. You'll then have to come up with a reason that they should have gritted where you fell, that there was salt available, and that yuo were taking care for your own safety by watching where you put your feet and wearing sensible footwear. Simples.

Surely it would be better if you could stick a claim in for the broken thing to prevent it happening again, rather than someone getting rich - or as it seems now, people getting nothing and the cause still existing...?
