if you want to get into definitions, look up Naill Whitty's revolutionary expose on the topic of culpa, Stair memorial encyclopaedia volume 14, paras 2087 onwards. feel free also to peruse Lord President Hope's 5-fold model of culpa Kennedy v. Glenbelle in 1996 Session Cases.

Oh what have I started!!

Off the air doing what I’m meant to for a couple of hours and you all fall out.

To bring us back on topic, I mentioned negligence because I was giving MMC the benefit of the doubt by assuming that they are honest, albeit negligent (or perhaps stupid). If they want to pitch up and say that they were being dishonest then fair enough.

I've been told that some sweeping changes are about to be implemented to the servicing departments throughout the JM group. Keep all your fingers crossed.

It's not only Lotus servicing that JM Group have a problem with. My brother has an RX8 and has had numerous wars with them.

Very sad to here of your story Neil and the numerous others on here.

This is maybe quite damning of me to say this but I often think MMC "create" certain issues with cars on purpose to balance their books to ensure their existance. Perhaps I am just being cynical. However, when I took my car into MMC for a replacement heater motor under warranty, just like yourself Neil, a hole/leak appeared in the rad????? More labour costs for them to reclaim.

I just cant help but think all they could see were the pound signs. Furhter more thereafter when I picked the car up the horn was disconnected !!! requiring clam off again. Probably hoping I wouldnt notice until MOT time and a nice big clam removal bill would land at my feet. Unbelievable.

As you say, hopefully the shake up may improve matters - not holding my breath though.

Will be taking a wee drive south for the time being.

By the way this is all just nomenclature and irrelevant.

If the bbaastards gave a sh*t "accidental diagnoses" / negligence blah blah etc would rarely happen.

By the way, whther they read this forum or not is also irrelevant - if they gave a shhit they would have listened ages ago and this reputation would have died ages ago too. They might even have sought out this website for feedback.

The gusto, of salesmen....pffff!! They are just as bad. their job is a bit sweeter cause they can wash there hands of us once they get the cash, which is why they are always sweet and smiling - the fact remains - these kkunts know their service dept. and they have the brassneck to looks us in the eye and sell us their stuff.

And, Shooomer, mate, whos side are you on any way? You're really not supporting the cause here and have unfounded comments. Have you read our experiences. ....Have you got a vested interest perchance?

I dont know much about law and the power of consumers and I think we've all got enough evidence here to close down these cowboys.

What the hell are we putting up with?? Im thinkin hard how to deal with this, but like most of you i have commitments and stuff - but i think if we get togther and complie ideas, we will create a better aftersales future for each of us.

Jeez, if i had the capital and the know how i would open a dealer and service dept tomorrow for all of us...Jeez, talk about an untapped niche.

Dan, you are probably as brilliant as we all report!! Dont we all think it is sad as hell that he and Falkand at least, are the only trustworty ones in our proximity?? Its crazy.

Here comes the first idea...you all wanna be shareholders in a new Lotus dealership?? Each of us part time sales and service staff? I would love to do that a couple of days a week in place of my current profession - which i already love.

How could a dealer be better run than by a crowd like us?

I have some captial. Do you guys? Who has some know how in setting it up?

Perhaps Shoomer is calling as he sees it - I do and I don't have any major issues with MMC in either their sales or aftersales service.


At the end of the day you can only have a rant if you have a valid complaint against the service levels you have recieved from them - anything else is just jumping on the bandwagon which can be dangerous.


We've had a few folk have a go at elise servicing but it is hellishly expensive as you need premises,tools and most importantly insurance. I know where you are coming from though - I've often though that if I was lucky with 6 numbers on a Wednesday/Saturday about going down that route and handpicking a few of the technicians from MMC and starting up my own servicing business focusing on the car and the issues rather than how many passed through the doors.

It's unfair to come on here and ask if folk have a hidden agenda, personally I've always had great service from MMC and get on really well with Graeme - there's not many sales folk who'll track across a muddy field with a cup of coffe for someone who had bought a car from them over a year previous.

Accusing Paul of collusion in some fraud is a step too far - if you knew him you would know that's bollocks.

What you said about Graeme is just outrageous. I could just as well accuse you of the same thing, with just as much fact to back it up. The "unfounded comments" is priceless considering what you just said about the salesman ...

With communication skills like those just demonstrated, forgive me if I am not falling over myself to enter into business with you. Will you talk to disgruntled customers like this?
