I got a summons a few years back it came with a letter saying that if I paid the £60 fine and took the 3 points that would be the end of it. but as it turned out the court was on strike that day so I got off scott free

Friend of mine just recieved a charge relating to 101 on the A90 (not sure if 60 or 70 section), he has previous speeding convictions (which they quoted on the paperwork he was sent) but I think is OK points wise at this time (I'm guessing they are going for habitual speeding by quoting previous).
Safe to assume he'll get a ban ? If so is there any point in getting some legal help involved to try and avoid the ban (preferring fine+points in his case) or is that a waste of time ? Any recommendations for speeding aware legal people ?
Yeah - he shouldn't keep getting caught speeding, but he did . . .

Hi Fd,
If he needs his licence for work you can usually get off a ban but only once.
Its not his livelihood they care about its the livelihood of others ie employees, giving granny a lift to the shop etc etc. Usually suited and booted + lawyer in court helps. Really depends on the mood of the migistrate on the day and the road conditions etc etc of the offence. HTH cheers Ed

Just sending the form back in and pleading guilty. However I have put the following in as mitigating circumstances, most of which is, of course, true.
I have to send in both my new style driving licence and the part two, but fortunately I had misplaced my part two a while back, and got new licences. This means that I can send them in, but still have a licence for France next week.
Should know the result by the time that I get back.

I was hoping to attend the court hearing, but I can now no longer travel that distance. I am a 66 year old, 100% disabled War Pensioner, now on crutches, but since the speeding offence in March, my condition has deteriorated, and I will soon have to use a wheelchair.
I have no defence for exceeding the speed limit on the Motorway, but I did not realise or intend to go above 90mph. I had just bought the Lotus Elise as I had always wanted one, but could not afford one, but this was one of the oldest ones, and left hand drive, so I bought it cheaply. This was my first journey away from home, and on a Motorway, for many years, and I went down to the Lotus Show at Donington with the Lotus Elise Club for the weekend. I was in the middle of the group, so I did not have to navigate, and went at the same speed as they did with no problems.
However when we left Donington to come home on the Sunday, I had a vibration in my front wheel and had to call the AA. They came very quickly, the wheel nuts were loose, so I was soon on my way, but my friends were well ahead of me, I was not comfortable driving on my own, so I arranged to meet them at the Scotch Corner Services. I wanted to get home before night and not hold them up, so I set my speed the same as the cars that were overtaking me.
As my car is a LHD, the speedometer is marked in kms/hr, but it does not have the usual inner circle of mph. The conversion is 5/8ths, so I was halving it and adding a bit, and cruising at around 150km/hr. However as the Police officer pointed out, this was not accurate enough and equated to 94mph, or 97 when he actually targeted me.
I realise that regardless, this was my own fault, but wished to point out that it was not intentional, and I had not realised that I was driving at over 90mph. He also explained that if I had been driving at 95mph, I would have received a fixed penalty of 3 points and a £60 fine, but I was in the 95-100 band, which meant a Court Summons.
I can now no longer drive the Elise and have a Motability car. As I can only walk a short distance, I do depend on the car for my independence and not be housebound, so I would be grateful if you could take this into consideration if there was a possibility of losing my licence.
I have been driving for fifty years now and never had any points on my licence, nor been charged or convicted of any offence.
