Couple of points, first is that the fact that he does not have insurance does not mean that you do not have a claim. It just means that there is no insurance to pay the claim. You can still make a claim against him and in the event of your claim being successful he will have to pay it from his own pocket. Second point is that I agree with Robin, check your policy carefully, the default position of these companies is to say that “it is not covered”. You might also have legal cover to pursue in terms of your house hold policy. Most of them have circa £50k of cover.

Do you know whether the other party has any assets.

Final thought, if he is convicted then you are the victim of a criminal injury and could make a criminal injuries compensation claim.

You are right that I can make a claim but none of the insurers I have spoken to are willing to fund a claim as any outlay may not be recovered and from what little I know of his background ( divorced, & wife/ kids have family home while he rents) don't think he has much in the way of assets so I could end up with a ruling in my favour but financially out of pocket if he can't pay.
A conviction might be my only option for getting any compensation so waiting on the wheels of justice turning & in the meantime the Police have said they will try to find out if he has cover and will let me know. :roll:

Would a cycling insurance policy (3rd party liability), or a car insurance policy for that matter, still pay out if the the insured was subsequently charged with either careless or even dangerous cycling/driving ?

They would pay out to the third party but may penalise or not pay out to the policy owner as they were author of their own downfall.
I am simply needing evidence that any policy exists in order that there is a source to claim against. If he is found guilty the courts can award damages against him ( but may end up being £x a month if he is cash strapped), but more importantly for me there may potentially be criminal injuries compensation available.
