Any employment lawyers out there?

Post by pete » Thu May 02, 2013 11:22 pm

I'd really appreciate some advice.

Mrs Pete has just been told her working hours are to increase, by the equivalent of 2 months a year. More extra attendances than she gets holiday.

It doesn't seem right and will have a massive effect on our lives, yet she's being told there is little she can do about it.

Errm. Anyone any ideas?

Shift changes? What do the regs say? (sorry not lawyerly, but regs may also have an effect).

Should have said, we both know the regs inside out. I'm really looking for contract advice I think.

Breach of contract ?
Indirect sexual discrimination, women are more disadvantaged than men as they are more likely to be responcible for childcare.
If it's a fundamental change, you could push for a redundacy payment.
IF you say no and get sacked you could go for unfair dismissal.
Requst flexible hours for childcare.

There is a chap called "Breadvan" over on PH in the "speed, plod and the law" forum who is a top barrister in Employment Law (a real expert as opposed to an Internet one) and who has regularly offered detailed advice to folk. Might be worth a shout over there?

Whatever the case, Pete, it sounds pretty shocking. Hope you reach an amicable conclusion.

I may be able to root out a specialist if Breadvan falls through.

Thanks for all the comments.

I'll try PH later (although that feels cheeky as I'm not really a contributor to the forums). Thanks for the suggestion though.

Nizzy - all yours are good but if it comes to suing we are screwed ;) If she has to leave I can see us both having to move :(
